The name of this Association shall be known as:  TROPICAL MOBILE HOME OWNER'S ASSOCIATION, INC., a Florida not for profit corporation.


1. To benefit the owners and residents of the Association.

2. To promote a continuing line of communication concerning the activities of the Association.

3. To promote fellowship and social contact among the membership.

4. “This community shall be governed by Chapter 718/720 of the Florida Statutes as exists on the date hereof, and as may be amended from time to time”


1. All property owners shall be members of the Association.

2. All members shall abide by the terms and conditions of these by-laws and of any action taken by the Association pursuant to these by-laws and shall pay their annual maintenance fee and shall pay their equal share of any costs of improvements or maintenance fees approved by the Association.  All such costs shall be levied against such parcels as one (1) share per parcel regardless of how many persons reside on said parcel.

3. Nonpayment by Association members of fees and assessments shall result

in the following:

a. All maintenance fees levied by the Association shall be paid  by January 31st of each year.

b.After the 31st of January, the owner will be notified by certified return receipt requested mail that a late fee equal to 5% of the amount due

will be levied each month on the total amount due.   

This fee is compounded monthly.

c.A member may appeal to the Board if there are extenuating circumstances.

d.A lien may be placed on the member's property.

e. The lien shall also accrue interest and any attorneys' fees and cost incurred by the Association in the collection process.

f.Suspension of voting rights.


1. Voting privilege shall be limited to one (1) vote per parcel.

2. Members in good standing have a right to vote, in person, by absentee ballot

or by proxy when written ballot is required at an Annual meeting.  Requests must be made to a board member at least 7 (seven) days prior to the meeting.


1. ANNUAL MEETING:  The association shall hold an annual meeting in January for the transaction of any and all proper business.  The election of Directors, if one is required, must be held at this meeting. The minutes of this meeting shall be read and approved at the next regular monthly meeting.

2. SPECIAL MEETING:  Special meetings must be held when called by the Board or by at least ten (10) percent of the total voting interest of the Association.  Business at a special meeting is limited to the purpose described in the notice of the meeting.

3. MONTHLY MEETINGS:  The Association shall have a monthly meeting from November through April.  Should a meeting fall on a holiday, then such meeting shall be rescheduled.

4. NOTICES: Board meetings, Park meetings and Special meetings shall be posted at least 48 hours before a meeting.

5. BOARD MEETINGS: All Association members have a right to attend Board meetings. If a member wants to place an item on the agenda, a forty eight (48) hour written request of the Board is required. The item will be added to the agenda, and the member has the right to speak to the item at that meeting.

6. RIGHT TO SPEAK:  Association members have a right to speak at any meeting with a time limit of three (3) minutes, with the following exceptions: Board meetings the member is limited to speaking 3 minutes to the item they requested be put on the agenda. Special meetings – members may speak 3 minutes only to the topic being discussed at the meeting.

7. Abbreviated Robert's Rules of Order shall be followed at all meetings.

8 All cell phones shall be turned off or set on vibrate during all meetings. Incoming calls must be taken outside.


1. The number of eligible voting members attending a meeting shall constitute a quorum.


1. Funds may be raised by special projects provided such projects are approved by the Board of Directors.

2. No expense shall be incurred against the Association by any person without the approval and consent of the Board of Directors or by a vote of the membership.

3. An annual donation of two hundred and fifty dollars ($250.00) shall be made from Association funds to a charity as a memorial to deceased parcel owners.

4 Disbursement of up to $500 may be made with approval of the Board of Directors. Amounts over $500 require membership approval.

5 A Buy-in fee of $500 will be charged at the time of purchase of any property which results in a new owner taking occupancy of that property. Persons already named on the deed will be subject to the buy-in fee upon taking occupancy of the property. [Exception – Those named on the deed prior to January, 2016 will not be subject to the fee]. Monies collected will be added to the Road Fund.


1. A nomination committee shall be appointed by the Board of Directors which consists of three (3) members of the Association who are not on the Board of Directors.

2. Election of Directors of the Association, for the terms that have expired, shall be at the Annual Meeting in January of each year.


3. The Board shall consist of a minimum of five (5) and a maximum of seven (7) members.  All Association members in good standing shall be eligible to serve on the Board, and a member may nominate himself/herself as a candidate for the Board at a meeting where the election is being held.  Directors must be elected by a majority of the votes cast by eligible voters.

4. Should there be more than one nominee, then voting shall be by written ballot.  Should there be only one nominee for each vacancy, then a vote may be taken by a show of hands.

5. Members of the same household may not serve on the Board at the same time.


1. The Directors of the Association shall be:

President, Vice President

Treasurer, Secretary

Directors at Large

2. Term of office:  All Directors shall serve for three (3) years.  Directors may be reelected to successive terms as the Association may decide. A director shall not miss more than three (3) meetings in a cycle from November to April. If a director misses three (3) meetings, he/she may be replaced by appointment of the Board.

3. Vacancies:  All vacancies of Directors of the Association, between annual meetings shall be filled by appointment of the Board of Directors to complete the remainder of that Director’s term.

4. Duties of Directors:

a.  President:  Shall preside at all Association and Board of Director's meetings; shall serve as ex-officious member of all committees (with the exception of the nominating committee) and exercise general supervision over all Association affairs.

b.  Vice President:  Shall assume all responsibilities, rights and privileges of the President during his/her absence.

c.  Secretary:  Shall keep accurate minutes of all meetings of the Association and the Board of Directors.  Shall perform all correspondence as deemed necessary by the President and shall assume the responsibility of the President in the absence of the President and Vice President.

d.  Treasurer:  Shall receive and account for all monies belonging to the Association and disburse it pursuant to these by-laws.  

e. Directors at Large:  Duties shall be at the discretion of the Board.

f.  Board of Directors:  Shall have the authority to conduct Association business between meetings, shall appoint any special committees it may deem necessary, shall serve as representatives of Tropical Mobile Home Owner's Association, Inc. and shall have the authority to appoint or remove block persons.


  Bylaws may be amended at any annual or special meeting of the Association provided that any proposed amendments shall have been presented in writing and read at the previous stated Association meeting.  A quorum must be represented and decisions shall be made by a majority of the quorum. Proposed By-Law changes will be distributed in writing to the membership in advance of the vote


  The regulations and restrictions that have been made a matter of Public Record in Pasco County, Florida shall be regarded as effective by all members of the Association.  The recording of same can be found at the County Office in Dade City, Florida.

  These regulations and restrictions shall be regarded as in force and binding upon all members of Tropical Mobile Home Owner's Association, Inc. and shall supersede all previous recorded regulations and restrictions.

  The title of all said lands shall be subject to all of the following regulations and restrictive covenants running with the land, to-wit:

  1. No garbage pits to be excavated on said lands. Home owners to install septic tanks; the same to comply with specifications of Pasco Board of Health.
  2. No children under eighteen (18) years of age shall be allowed as permanent residents on said lands.
  3. No mobile home that is over five (5) years old to be placed on said lands; said lands being restricted to only one mobile home on each deeded property and shall be subject to permits from Pasco County. Should a home owner elect at any time to sell his/her property, it shall be sold as one unit; a unit being one mobile home and deeded property. Exceptions: replacing the mobile home with one mobile home per deed.
  4. No recreation vehicle can be parked on said parcel of land for more than seven (7) days unless under carport/attached roof. It can never be hooked to sanitary system per Board of Health Regulations. Same said recreation vehicle shall not be returned to the property for at least seven (7) days. A recreation vehicle includes, but is not limited to the following specific vehicles: “aircraft”, “camper”, “camping trailer”, “motor home”, “travel trailer”, “utility trailer”, and “watercraft” per definition of recreation vehicle from Google.
  5. No livestock of any kind to be kept on said lands, including household pets. Visitors may bring household pets with them for no longer than two (2) weeks. Pet is to stay with visitor – NOT allowed off the property where visiting or left to be pet sat.
  6. Home owners shall keep their premises in good maintenance/repair, including the skirting between the bottom of the trailer and the ground.
  7. All utility rooms, sheds and/or additions shall be under or attached to an existing roof and be no closer than five (5) feet on sides and back and ten (!0) feet on the front of the property line, with prior approval of the Board.
  8. No open fires or incinerators shall be allowed on said lands for the purpose of burning. Closed fireplaces are permissible.
  9. Home owners, successors, or assigns are prohibited from constructing a well on above described lands.
  10. Each deeded parcel on land shall be subject to utility easement and restrictions shown on each member’s deed.
  11. No excavations of roads located in Tropical Mobile Home Owner’s Association, Inc., shall occur without first securing the written consent of the Board of Directors.
  12. The cost of all maintenance and improvements of streets, recreation building, shuffleboard, bocce court and picnic area located in Tropical Mobile Home Owner’s Association, Inc. shall be equally shared by all parcel owners.
  13. Lawns may not exceed five inches in height. If grass exceeds beyond the five inch height and is not mowed the Board will first notify the property owner. Then, if it is not mowed within 10 days, the Board will have it mowed and bill the owner.
  14. In order to maintain an owner-occupied park and the high standards that come with such a park, no person may have ownership interest in more than one unit. NO UNIT MAY BE RENTED, LEASED OR SOLD ON LAND GRANT. With prior Board approval, association members may purchase owner deeded property for the sole purpose of changing their residency to the newly purchased property or renovating it to sell. This member will retain only one vote. Construction materials must be stored under roof for no longer than 9 months.
  15. Owners may have a yard sale up to twice a year, not to be held at the same time of the “”Park Sale”. Materials may be collected up to 5 days in advance, stored under roof and sale will be torn down within 2 days after the sale.
  16. The subdivision/mobile home park/cooperative shall be an older person’s mobile home park. At least one person 55 years of age or older must be a permanent occupant of each unit. Persons between the age of 18 and 55 may occupy and reside in a unit as long as one of the occupants is 55 years of age or older. The Board in its sole discretion shall have the right to establish hardship exceptions to permit individuals who are more than 18 years of age, but less than 55 years of age, to occupy a unit to meet situations such as a death or disability of a spouse, family member or co-occupant. All sales shall be subject to the prior approval of the Board pursuant to a background check at the buyer’s expense to assure compliance with the provision and to assure that no hardship exception be granted which will raise the total percentage of such occupied units above twenty (20) percent.
  17. Public Safety: No fireworks shall be discharged within the boundaries of Tropical Mobile Home Owner’s Association, Inc.
  18. To borrow items from the clubhouse (i.e. card table, chairs, kitchen equipment) a member must have it approved by a member of the Board before said item can be removed from the premises. The white tables are NOT to be removed from the clubhouse.
  19. No individual yard sales to be held during the week of the annual Tropical Mobile Home Owner’s Association, Inc. “yard sale” held at the clubhouse.
  20. Fines: An association member not abiding by the Regulations and Restrictions of Tropical Mobile Home Owner’s, Inc. bylaws may be subject to penalties/fines.
    1.  Written notice shall be sent by certified return receipt requested mail, delivered by hand, sent by email and/or USPS requiring compliance within ten (10) days of receiving notice.
    2.  Noncompliance will result in a fine of twenty-five dollars ($25.00) per day for ten (10) days.
    3. Further noncompliance will result in a fine of fifty dollars ($50.00) per day until in compliance with our bylaws.
  21. Should it ever become necessary for the Association to retain the services of an attorney for the purpose of preparing a lien, collecting assessments, enforcing rules/regulations or to foreclose any lien, the home owner shall be obligated to pay ALL THE LEGAL FEES.
  22. The seller of any unit must direct the prospective buyer to the Tropical Park web site to provide them with a copy of the Park Bylaws and the Application for Purchasing Property. Purchasing Application along with all required documentation is to be completed by the prospective buyer and returned to the park for review by the Board of Directors. Application and all required documentation will be reviewed, and buyers will be interviewed by the Board prior to approval for membership.
  23. All perspective buyers and residents of that unit must have a Federal background check at the buyer’s/sellers expense. The Purchasing Application will direct the applicant to the approved source for the background check. Any person moving into a unit an any future date is required to complete an application and have a Federal background check.
  24. There shall be no fences erected within the park by owners with the exception of the outside perimeter with Board approval. Any existing fence must be removed at the time of sale or deed change at the owner’s expense.
  25. Only certified service animals are allowed in the park. Owners will provide documentation of annual licensing and updated vet certification to the Board (see Article XI-5 for the only exception pertaining to visitors).
  26. Any “grandfathered” emotional support animal owners will provide documentation of annual licensing and updated vet certification to the Board. Any such animal upon its demise may not be replaced.
  27. After using the clubhouse for a function, it is to be left in good order as outlined in the cleaning checklist found on the bulletin board in the clubhouse.
